What’s the difference between civil and commercial litigation?
The key difference is that a civil dispute involves two parties who are generally individuals acting in their own personal interests, whereas in commercial litigation, at least one party is an SME, corporation, sole trader, or other business entity. Commercial litigation cases are also almost always more complex than civil cases, since by definition a business involves more people (employees, shareholders etc) who have a vested interest in the outcome of the case.
What does a commercial litigation lawyer do?
The overarching goal of a commercial litigation lawyer is to resolve their client’s case in the most efficient and cost-effective way possible. In doing so, they’ll also try and minimise any associated impacts on the company’s finances, time, and reputation.
They’ll generally begin by assessing the background and circumstances of the client’s case, using this as the basis of a strategy that they feel has the best chance of producing a positive outcome. If possible, they’ll aim to ensure this solution satisfies all parties, but their overriding concern will typically be to protect their own client’s business interests. They’ll also be able to finalise agreements, and ensure that all legal documentation is correct, in order, and legally binding.
What is mediation?
Professional mediation is a highly effective technique that’s often used to settle commercial disputes out of court. It involves bringing in a trained mediator who’s neutral to both sides of the dispute. They will have the power to meet each party to discuss potential resolutions – they may do this alone, meeting each party independently, or organise a ‘round-table’ meeting with all parties in a single room. Our commercial dispute solicitors have an excellent reputation for achieving results at mediation.
