Farleys’ criminal law specialists have represented a client who was arrested for tax duty evasion.

Our client, a 77-year-old man, had been going on cruises, bulk-buying tobacco products and bringing them back to the UK. In total, he’d brought back 80kg of tobacco product without paying the tax duty which amounted to in the region of £32,985.60 of tax duty.

He was arrested and investigated for tax duty evasion.

How Farleys Were Able to Help

The man instructed Samuel Hinds of Farleys’ criminal law department to represent him during the police interviews and subsequent court case.

Our client had a previous charge for the same offence back in 2019 where he received a suspended sentence which ran until 2021. As a result of this charge, the starting point for his next offence was immediate custody due to his previous record.

Samuel negotiated on behalf of his client, putting forward mitigating factors regarding the offence and the man’s personal circumstances. Factors such as our client’s age, health and personal family circumstances played a key role in the mitigation put before the court.

As a result of Samuel’s representation, our client was instead sentenced to a 24-month community order which included six RAR (Rehabilitation Activity Requirement) days. He was also banned from travelling outside of the UK for two years and given a £250 fine.
