Ms L approached Farleys’ personal injury team after suffering injuries following an assault at work.

Background

Ms L was working as a teaching assistant in a residential school for young people with autistic spectrum conditions.

She was taking care of a 16-year-old child who should have been supervised by two staff including one male member of staff. She was alone. The child became aggressive and attacked her. Ms L was punched, headbutted and thrown against a wall. She was then kicked when she was on the floor.

Ms L’s injuries included bruising, lacerations, and clumps of hair had been pulled out of her head.

How Farleys were able to help

Ms L instructed Holly Barnes from Farleys’ personal injury team to act on her behalf in a claim against her employer for their negligence in not ensuring the child was correctly supervised. Holly successfully secured an admission of liability from Ms L’s employer just one month after instruction.

Our team instructed medical experts to assess Ms L’s injuries; both physical and the psychological impact the accident had had on her.

We secured a general interim payment while we finalised medical evidence and also secured funding for psychological treatment while the claim progressed. This meant that Ms L was able to be treated for her psychological injuries without delay while Farleys’ personal injury team continued to build the case the claim maximum compensation for her.

The claim submitted on behalf of Ms L included pain and suffering, loss of earnings and treatment costs. We successfully negotiated a settlement in excess of £7500.00 inclusive of treatment.

Holly Barnes commented,

Ms L experienced a serious assault as a result of the negligence of her employer. We were pleased to have secured this compensation on her behalf to allow Ms L to move forward and gain some closure after her traumatic experience.
