We recently had the privilege of helping a client, Mrs H, achieve justice after a deeply frustrating and distressing experience—not just from her personal injury, but from the negligence of the solicitors she had trusted to help her.
The Background
Mrs H suffered injuries during a flight to the UK operated by TUI Airways Limited when a heavy object fell from an overhead locker. Understandably shaken and in pain, she turned to a well-known national firm of solicitors to pursue a personal injury compensation claim. However, what followed was a second blow: the solicitors she instructed failed to issue court proceedings within the strict two-year limitation period required for such claims.
This mistake meant Mrs H lost her legal right to pursue compensation from the airline. The emotional and financial toll on Mrs H was significant. But all was not lost.
Holding Professionals Accountable
Mrs H approached Paul Mulderrig of Farleys Solicitors for advice on what could be done. After reviewing the circumstances, we identified a clear case of professional negligence. Solicitors have a duty of care to act with the skill, diligence, and timeliness expected of legal professionals—especially in time-sensitive matters like personal injury claims.
We brought a negligence claim against the original firm, arguing that their failure to act within the required timeframe constituted a breach of their professional duty.
The Outcome
After court proceedings were issued Mrs H reached a settlement of £20,000 in damages for the loss of opportunity to pursue her original personal injury claim. While no amount of money can undo the pain or frustration she experienced, this outcome represents a meaningful step toward closure and justice.
Solicitor Paul Mulderrig, commented:
“We are pleased to have secured justice for Mrs H after the distressing experience she endured—not only from the initial injury but also from the failure of her former solicitors to act within the required timeframe.
This case highlights the importance of professional diligence and accountability in legal practice. We hope this outcome brings Mrs H a sense of closure and reassurance that her rights have been upheld.
Why This Case Matters
This case is a powerful reminder of the importance of solicitors maintaining professional standards. Clients place immense trust in their solicitors, especially during vulnerable times. When that trust is broken through negligence, the consequences can be incredibly difficult for clients.
It also underscores the importance of acting quickly if you suspect your solicitor has made a mistake. There are legal avenues available to hold professionals accountable, and compensation may be possible if you’ve suffered financial loss as a result of their actions—or inactions.
