Mr B approached Farleys’ personal injury team about the possibility of making a claim for compensation after he was injured in a road traffic accident.

Background

Mr B was in his 30s when he was traveling as a passenger in a vehicle driven by a work colleague. He was in the front passenger seat and wearing a seatbelt when a vehicle cut across the vehicle he was traveling in, causing a collision.

Mr B attended his GP surgery following the accident and was referred to hospital for a chest x-ray. The x-rays showed no fracture but three days later, Mr B attended A&E as he was still experiencing pain in his chest. An MRI revealed he had suffered damage and trauma to his manubrio-sternal joint due to the impact of his seatbelt against his chest in the crash.

Mr B continued to suffer pain and stiffness in his neck, shoulders and upper back and was unable to return to work as a plasterer. He required assistance at home with every day tasks in the immediate aftermath and is still unable to complete strenuous household tasks and DIY which involves heavy lifting. He has also developed depression as a result of the chronic pain, restricted physical activities, and financial difficulties due to his unemployment.

How Farleys Were Able to Help

Mr B instructed Jane Chadwick of Farleys’ personal injury team to act on his behalf in a claim against the insurers of the driver of the other vehicle. Jane and her team instructed various medical experts to assess the extent of Mr B’s injuries, his current restrictions, and any future treatment he may need.

We argued that Mr B had been put at a disadvantage on the job market as he was unable to work in the field he previously worked in due to his injuries. We submitted a claim on his behalf to cover his injuries, loss of earnings, care and assistance at home, CBT therapy, and future loss of earnings.

Jane successfully negotiated damages of £180,000 at a joint settlement meeting without the need for Mr B to go to court.

Jane commented,

Mr B’s life has been significantly impacted by this crash and he has been rightly compensated to cover the cost of care and treatment. We hope the settlement will go some way to providing closure for him.
