Lancashire Accident at Work – Miss F awarded £17,500

Our client, Miss F*, approached Farleys following an accident which occurred in the course of her employment.

She was working as a stable hand. On the day in question, Miss F was asked by her employer to sit on a horse. While she was sat on the horse, the horse freaked, causing the client to fall from the horse. As she landed on the floor, the horse kicked out, making contact with her knee.

Miss F was taken to her local A&E department where an x-ray was performed and revealed a fracture to the knee area. At a follow-up appointment, another fracture was discovered in that area. Her knee was placed in a brace for six weeks and she was prescribed a course of physiotherapy.

Miss F was off work due to the injury for four months and experienced ongoing difficulties with knee pain when using it for a prolonged period. She experienced difficulty driving, was unable to continue her hobby of dancing, and could not wear high heels.

Miss F instructed Farleys’ personal injury team to act on her behalf in a claim for damages as a result of the accident caused by the negligence of her employer.

Farleys instructed medical professionals to assess Miss F’s injuries and give expert opinion on any future care needed. We also drew on the equine expertise within the team to establish the circumstances which caused the horse to react in the way that it did.

The claim submitted on behalf of our client provided for personal injury, psychological injury, loss of earnings, future care and treatment. We also claimed for future loss of earning on behalf of Miss F as she had to take the difficult decision to train in another career due to the potential barriers her injury had caused for her to continue to work in the equine industry.

The claim was successful and Farleys’ recovered damages totaling £17,500.
