Farleys’ personal injury team were instructed by Mr V in a claim for compensation against his employer after he sustained a serious leg injury at work.

Background

Mr V was working in a food processing factory at the time of his accident. The floor was very slippery and Mr V fell, seriously injuring his leg. Mr V fractured his femur and had to undergo surgery to insert metalwork.

He was unable to care for himself after the operation and had to return to his native Romania to receive care & financial assistance from his family.

How Farleys Were Able to Help

Jo Smith, personal injury solicitor at Farleys, was instructed to act on behalf of Mr V in an accident at work claim. Jo agreed to take the claim on a no win, no fee basis.

Mr V’s employers surprisingly tried to deny liability and claim he was entirely at fault.

This was clearly nonsense as the cleaning regime was not as good as it should have been and, after some negotiations with the insurers, liability was admitted in full.

Jo needed to establish how much the claim was worth, including the value of the injury itself as well as the losses Mr V had incurred as a result of the accident.

Jo instructed several medical experts to assess the extent of Mr V’s injury. Despite having returned to Romania for care and assistance from his family, he returned to the UK on several occasions for appointments with the medico-legal experts.

It was found that, as a result of the injury, Mr V was left with a limp and required orthotics in his shoe. He was also at an increased risk of developing osteoarthritis in the future.

Mr V had always had manual jobs, but the medical expert confirmed that he would struggle to return to that type of work and would be at a disadvantage on the labour market.

Our opponent’s medical expert didn’t agree and so negotiations with them were not straightforward and it was looking likely that the case would have to go to trial at court.

Thankfully, Jo managed to negotiate a successful settlement shortly before trial of £75,000. Mr V was very happy with the outcome as his life had effectively been put on hold after the accident.

Jo commented,

The impact this injury had on Mr V’s life was extensive, following the accident which was caused by the poor health and safety practices of his employer. I was pleased to reach this settlement for him to cover the costs he incurred, pay for future care, and allow closure on his experience. I wish him all the best in his recovery.
