Background
Mr X was employed as a steel fabricator and was instructed by his employer to undertake a highly complex construction project to weld together a skid for use in the mining industry.
Mr X was not given appropriate instruction by his employer and was instead left to work out for himself a way to complete the job. Mr. X and his colleague were trying to manoeuvre a large and extremely heavy curved metal plate into position using an overhead crane and magnet when the curved plate came away from the magnet. As a result, the part fabricated metal frame fell apart and one of the plates weighing in the region of 250kg fell onto Mr X’s foot and crushed it.
Mr X suffered a very severe crush injury to his foot with fractures of 3 metatarsals. He was left with ongoing pain and discomfort in the cold and difficulty managing at work.
How Farleys Were Able to Help
Liability for the accident was strongly disputed by Mr X’s employer. Nick Molyneux issued court proceedings on behalf of Mr X and was able to bring the claim to a successful conclusion, which resulted in Mr X receiving a substantial sum of damages in the region of £15,000 as compensation for the life-changing injury he suffered.
