Background

Mr E was involved in an accident when he was working as a builder on a platform at height. The platform had been poorly instructed by Mr E’s employer and his colleagues.

Mr E was on the platform when someone tried to pass tools to him causing the platform to move and Mr E had to jump before he fell from it. He landed on both feet suffering a devastating injury to his heel.

He had to be treated at hospital and had subsequent surgery on his injured heel.

How Farleys Were Able to Help

Mr E instructed Farleys’ personal injury specialist Nick Molyneux to deal with this case.

Mr E’s employer denied responsibility for the accident. They said that it was Mr E’s own fault and they even disputed that they were his employer. This was a stance that they maintained right up until the end of the case.

Nick instructed a nationally renowned orthopaedic surgeon to prepare a report on the severity of Mr E’s injury. Nick also instructed a consultant orthotist as Mr E needed inserts in his shoes to reduce the pain he felt when walking.

As Mr E’s employer (the defendant) disputed liability, it was necessary for Nick to issue court proceedings on behalf of Mr E. It was not until the week before trial that the defendant, via their solicitors, changed their approach and made offers to settle Mr E’s case.

Nick was able to secure a very substantial sum of damages for Mr E, who had also retrained following his accident to secure a better paid job.
