Mr K approached Farleys’ personal injury team about the possibility of making a personal injury claim after an accident at work.
Mr K was at work, moving pallets, at the time of the accident. One particular pallet he moved was missing a leg but Mr K didn’t realise this at the time. As he went to move it, the pallet caught on a nail from the pallet below and, as it was missing a leg, the pallet jolted down to the left and caused Mr K’s left arm to jerk. As a result, he suffered injury to that arm which left him unable to work.
How Farleys Were Able to Help
Mr K instructed Jade Jump of Farleys’ personal injury team to act in a claim on his behalf against his employer to recover the costs he had incurred as a result of the accident.
Jade got to work straight away issuing a letter of claim to Mr K’s employers, who admitted liability with no issues.
She then instructed a medical expert to assess the extent of Mr K’s injury five months after the accident. The medical expert established that Mr K’s injuries had been at their worst for around two months post-accident with residual discomfort which was aggravated by any lifting. He was recommended four sessions of physio to aid with his recovery which was estimated to be within 1-2 months of completing the physio.
Jade included the cost of this treatment in Mr K’s claim as well as his loss of earnings, after being off work for 3-months post-accident due to the manual nature of his job.
Negotiation of a settlement with Mr K’s employers took some time but Jade was able to successfully achieve a settlement of £3,500 for his injuries plus travel and medication expenses.
“When somebody suffers an accident at work, an unexpected consequence for many is the costs they incur as a result, such as medical expenses, travel expenses, and loss of earnings. This is where a personal injury claim can be vitally important in recovering these costs and ensuring they aren’t left out of pocket as a result of an accident which wasn’t their fault.
“We were pleased to have been able to assist Mr K in this instance and wish him all the best.”
