Mrs A approached Farleys’ personal injury team to act on her behalf after she was involved in a pedestrian vs car road traffic accident.
Background
Mrs A was a pedestrian who was involved in a serious road traffic accident when she was struck by a vehicle while crossing at a zebra crossing. A vehicle had already stopped to allow them to cross, however the driver of the vehicle failed to stop and collided with Mrs A, who was thrown onto the windscreen and then to the ground, losing consciousness. The driver, a provisional licence holder, was accompanied by her mother at the time of the incident.
Mrs A was transported by ambulance to hospital, where she was diagnosed with multiple fractures to her leg, rib fractures, a punctured lung and lacerations to her head and face. She underwent nail fixation surgery the following day and remained in hospital for 12 days.
Mrs A was not from the UK, but was visiting her family at the time of the accident. She had to extend her stay in the UK as a result of her injuries, as she was not able to fly for over a month.
How Farleys Were Able to Help
Farleys were recommended to Mrs A and she therefore instructed Jade Jump to act on her behalf for a personal injury claim.
Jade submitted the letter of claim to the driver of the vehicle and their insurer. An admission of liability was soon confirmed by the insurers. Jade instructed a medical expert to examine Mrs A remotely (due to her returning to her home country) and obtained a report which dealt with all Mrs A’s injuries in detail. Given that the expert was of the opinion that Mrs A was reaching an end-stage in her recovery, which was thankfully going very well, Jade sought to commence settlement negotiations with the insurance company.
Successful Settlement
The insurance company initially made an offer of settlement in the sum of £33,000, but Jade advised Mrs A that this offer should be rejected and we should seek an increase in that figure. After negotiations with the insurer, Jade was able to secure a settlement of £38,000 for Mrs A, which she was pleased with.
