From 6 April 2026, important changes will come into effect that will impact the value of Employment Tribunal claims involving discrimination, harassment, victimisation, and certain types of unlawful detriment. These changes relate specifically to the compensation awarded for Injury to Feelings; a financial award designed to recognise the emotional distress caused by unlawful treatment in the workplace.

These awards are grouped into what are known as the Vento bands, and from April 2026 the updated bands will be:

  • Lower band: £1,300 – £12,600

    For less serious cases, such as one‑off or isolated incidents.

  • Middle band: £12,600 – £37,700

    For cases that are more serious but do not justify the highest level of award.

  • Upper band: £37,700 – £62,900

    Reserved for the most severe and long‑lasting cases of unlawful conduct.

In very rare and exceptional circumstances, the Tribunal may award more than £62,900.

Why does this matter?

These uprated figures are significant for both employees and employers, especially at the early stages of a dispute. Whether someone is considering raising a grievance, entering Early ACAS Conciliation, or formally submitting a Tribunal claim, the potential value of a case is now higher than before. This can influence strategy, timelines, and negotiations.

For employers, the stakes are equally high. Defending Employment Tribunal claims already carries financial and reputational risks, and the increase in potential compensation means that mismanaging workplace issues, particularly those involving discrimination, can now have even greater consequences. When considering settlement discussions or assessing legal exposure, these updated bands should form part of any risk evaluation.
