Farleys Solicitors’ serious fraud and business crime specialists recently represented an investment company director accused of conspiracy to defraud in a highly complex case.
Our client was one of nine defendants charged in relation to an alleged large-scale pension fraud, valued at over £5 million. The prosecution claimed that the fraud involved the unlawful liberation of pension funds through a network of sham loans and overseas payments. The case was built on extensive financial documentation and regulatory scrutiny, making it one of the most intricate financial crime cases in recent years.
How Farleys Were Able to Help
Given the complexity of the case, which involved intricate financial transactions and HMRC regulatory provisions, the investigation itself spanned five years. Our legal team worked closely with forensic accountants and industry experts to dissect and challenge the prosecution’s allegations. The trial at Newcastle Crown Court lasted nine months, with the jury deliberating for 20 days before reaching a verdict.
Partner Paul Schofield, instructed Caroline Goodwin KC of Libertas Chambers London to act as lead counsel in the case. Through a meticulous and robust defence strategy, we were able to systematically dismantle the prosecution’s arguments, ultimately leading to our client’s acquittal.
Commenting on the outcome, Paul Schofield said,
Justice has been done. I am very pleased for our client who is a professional person in his 50’s without a criminal record and who has had to endure, with his family, 6 years of this case hanging over him. He denied any wrongdoing from the outset and has been vindicated. I am grateful to our instructed experts namely Caroline Goodwin KC and her junior Estelle Chambers, along with forensic accountant Claire Berrington, all of whom have been outstanding.
