Background

Mr B approached Farleys in August 2019 after being involved in a road traffic accident. He was driving along a road when the defendant pulled out of a side road at speed when it was not safe to do so and collided with Mr B’s car. This caused an injury to Client B’s shoulder with associated headaches.

The accident occurred in April 2019, meaning that Mr B was well within the 3-year limitation period.

How Farleys were able to help

A claim form was completed a submitted to the insurer of the defendant driver, detailing the incident and why their insured was at fault.

The defendant’s insurance company responded to the claim form and admitted that the accident was caused by the breach of duty of their driver, and that the accident had caused some loss to the claimant. However, the defendants did not admit to the nature and extent of that loss. It was, therefore, up to our personal injury solicitors to quantify the claim for Mr B.

Mr B’s medical records were applied for, and a consultant orthopaedic surgeon was instructed to examine the Claimant to provide a full and detailed report dealing with the injuries sustained, the treatment received, their present condition, and in particular, the client’s capacity for work and giving a prognosis for recovery.

Overall, Farleys Solicitors successfully settled the compensation claim for Client B, who received £20,000 in damages in September 2024 to cover the cost of pain, loss, and suffering caused by the crash.
