Farleys’ commercial litigation team were instructed to act on behalf of a company in pursuing a claim for unpaid invoices against a high-profile individual.

Background

The high-profile individual had ordered some bespoke goods from the company. The company accepted the order on its standard terms and delivered the goods. Following delivery, the company raised its invoices as per its terms. The value of the order was £36,500. No payment was received and the individual ceased all communication with the company.

How Farleys Were Able to Help

The company instructed Rachel Harrison, commercial litigation specialist at Farleys, to act on its behalf in recovering the debts owed to them by the individual.

Rachel prepared initial pre-action correspondence to the individual, setting out the details of the claim. The individual ignored all communications. Rachel then issued proceedings in the County Court for £36,500 plus additional interest accrued since the invoices were issued. The individual failed to respond so Rachel applied to enter judgment for the full value of the claim, interest and fixed costs. The total judgment came to approximately £41,500.

Despite the judgment, the individual still didn’t pay so Rachel instructed high court enforcement offices to obtain a writ and enforce the judgment. The officers attended the individual’s address at a well-known location on several occasions. On one visit they saw several vehicles (including a classic sports car) so they completed DVLA checks to find out whether they were owned by the individual. The officers then took control of the vehicles.

The individual eventually engaged with the high court enforcement officers and paid over £50,000, made up of the original judgment, interest accrued, and the high court enforcement officers’ fees.

As a result of Rachel’s diligent pursual of the debt, her client has recovered all of the invoices owed and over £8,000 in additional interest for the late payment.
