How Much Compensation Can I Claim for a Back Injury?

Back injuries vary so much in their severity and long-term impact that it’s not possible to give a definitive figure without knowing the details of your case. Compensation is made up of two elements:

  • General damages — for your pain, suffering, and loss of amenity (the impact on your enjoyment of life).
  • Special damages — for financial losses including lost earnings, the cost of medical treatment, physiotherapy, care and assistance, travel costs, and any future losses where your injury has ongoing consequences.

The Judicial College Guidelines (18th Edition) set out indicative general damages ranges for back injuries based on their severity. These figures cover pain, suffering, and loss of amenity only, they do not include special damages, which can significantly increase the total value of your claim.

Most Severe Back Injuries (£120,340 – £212,670)

The most serious cases involve spinal cord damage, significant nerve root damage, loss of bladder or bowel function, or severe and permanent pain resulting in total or near-total incapacity. These injuries have life-changing consequences and attract the highest awards.

Moderate Back Injuries (£11,730 – £47,320)

This bracket covers a wide range of injuries, including disc lesions, crushed vertebrae, and sprains that lead to persistent pain or instability and require significant treatment. The bracket is divided into two sub-categories:

  • Serious (£33,880 – £47,320): Disc lesions or fractures causing chronic pain and longer-term disability.
  • Less severe (£11,730 – £33,880): Injuries with better recovery prospects, but still causing lasting discomfort and some ongoing limitation.

Minor Back Injuries (£2,450 – £11,730)

This bracket covers soft tissue injuries, sprains, and wrenching injuries where symptoms resolve within a few years. Awards within this range depend on recovery time:

  • Recovery under 2 years: Up to £5,150
  • Recovery between 2 and 5 years: £5,150 – £8,250

How Long Do You Have to Make a Back Injury Claim?

In most cases, you have three years from the date of your accident to bring a back injury compensation claim. There are important exceptions to this rule:

  • Children: The three-year period does not begin until the child turns 18, giving them until their 21st birthday to bring a claim. A parent or guardian can bring a claim on their behalf before that point.
  • Date of knowledge: If you were unaware that your injury was caused by the accident until a later date, the three-year period may run from the date you became aware, known as the ‘date of knowledge’.
