Background

Miss H was travelling as a passenger in her boyfriend’s car along Barbara Castle Way in Blackburn. The car overturned and Miss H’s boyfriend fled the scene. Miss H broke her neck in the crash and suffered a subsequent stroke at the hospital.

She was taken for surgery four days after the accident and was required to wear a halo brace for two months afterwards. She also suffered scarring to her face. The fracture in her neck was deemed to be possibly unstable and required examination by a private spinal surgeon and other specialists.
