An inquiry into Randox Testing Services, who provide forensic evidence testing for 42 UK police forces, has found evidence of manipulation in the forensic testing process of at least 40 motorists convicted on drug driving offences.

The motorists have now been cleared and a further 50 drug driving cases have now been dropped.

As part of the inquiry, 10,500 test results are being reviewed and 2,700 cases have so far been re-analysed, with the National Police Chiefs’ Council describing it as a “most serious breach” of forensic science standards.

It is worth noting that Randox have revealed in a statement that they acted as “whistle-blower” when the manipulation of evidence by its own staff came to light in January 2017. However; this will provide little comfort to the dozens, and potentially more, motorists who have served bans, and some even fined, following these wrongful convictions.

These bans will have had a huge effect on the lives of these motorists, some of which have lost employment as a result and struggled to pay bills.

As the review of past cases continues, it is likely we will see more convictions quashed, potentially leading to a drop of public confidence in forensic analysis. This type of analysis is often the make or break of a driving offences case involving suspected drugs or alcohol influence so prosecution teams must ensure there has been no risk of contamination or manipulation of evidence before pushing for a conviction.
