Farleys Solicitors LLP acted on behalf of Mr D from Blackburn who had suffered personal injury as a result of a road traffic accident. Mr D had already instructed Solicitors to act on his behalf but he was unsatisfied with the standard of service received as the previous Solicitors had in 12 months failed to arrange a medical report for Mr D or respond to his calls. Farleys took instructions from Mr D and sent a letter of claim to the Defendant’s representatives.
The accident occurred when Mr D was on his way to Hospital for an operation and caused him significant distress as to whether he would be able to get to the Hospital on time. Mr D also attended upon his General Practitioner after the accident as he had suffered injury to his neck. The pain worsened after the accident and radiated into both arms – particularly the left arm.
Mr D had significant pre-existing problems at his neck and so Farleys Solicitors LLP instructed a Consultant Orthopaedic Surgeon to prepare a report. The report needed to deal with the interplay between the accident and its effects as well as the pre-existing problems.
How Farleys’ Personal Injury Team Helped
Due to the complexities of the medical evidence, it was not possible to settle Mr D’s claim prior to expiry of the Limitation Period three years after Mr D’s accident. Accordingly, Farleys issued Court Proceedings and then served them upon the Defendant. In in order to do so, Nick Molyneux instructed an Expert Barrister to prepare the necessary paperwork before having Mr D consider it and sign the same. A Defence was then filed at Court admitting liability before Farleys were able to secure damages for Mr D exceeding £7,000.
