CICA Domestic Abuse Claims

CICA Domestic Abuse Claims

At Farleys, we act for survivors of domestic abuse pursuing CICA domestic abuse claims on a no win, no fee basis. This means from the outset that you can access specialist legal support without paying upfront legal fees, and you will only pay our agreed fee if your claim is successful. We will explain the terms clearly before you decide to proceed, so you can make an informed choice with confidence.

Domestic abuse often leaves deep and lasting scars, with effects that can touch every aspect of a survivor’s life. If you have experienced physical or emotional abuse, you are not alone. Many people understandably feel isolated or uncertain about their rights, but it’s important to know that support is available, and you may be entitled to compensation through the Criminal Injuries Compensation Authority (CICA).

Our team regularly helps survivors of domestic abuse secure compensation and move forward. We understand that coming forward can be daunting. Whether your abuse was recent or historic, you deserve to be heard – and you may be eligible to claim.

You are entitled to seek compensation. To discuss CICA domestic abuse claims with our team, call us on 01254 606 008 or fill in our online enquiry form.

What is a CICA abuse claim?

The CICA (Criminal Injuries Compensation Authority) is a government-funded scheme created specifically to help victims of violent crime. Domestic abuse is sadly common, but too many survivors never realise that CICA can help.

If you’ve suffered physical or psychological injury as a result of domestic violence, you could be entitled to compensation – even if your abuser has not been convicted or identified.

What is Covered?

The CICA can award compensation for:

  • Physical injuries
  • Psychological harm, including trauma, anxiety, depression and PTSD
  • Sexual abuse and sexual assault
  • Loss of earnings and some special expenses because of your injuries

Abuse by partners, ex-partners, family members, or anyone else you lived with may be covered. Violence, sexual offences, and assaults are all recognised, and each case is assessed individually. Our abuse solicitors will learn the details of your case and always ensure you feel comfortable and listened to throughout the claims process, so you can have some peace of mind that your situation is being handled with care.

Psychological Injuries Are Recognised

The CICA can compensate for recognised physical and psychiatric injuries – including anxiety disorders, depression, PTSD and other mental health conditions – if supported by medical evidence.

What Could Prevent a Claim?

Unfortunately, there are factors that could have a negative impact against your case. The CICA applies certain rules:

  • Unspent criminal convictions can affect eligibility (speak to us for guidance if this applies)
  • You must cooperate with police and the CICA
  • Claims should be made promptly within the appropriate time limit
  • There needs to be sufficient evidence of violent crime

Even if you are unsure about any of these, please reach out. We can assess your situation and advise you confidentially.

What Evidence is Needed?

Every case is different, and we understand that sometimes, collecting evidence isn’t easy, especially if you’re trying to process what has happened. However, our team of abuse solicitors can help you access the right evidence and complete your claim. A main piece of evidence we’ll require is your crime reference number.

We’ll be able to provide guidance on any other evidence you may have that will help build your case, so don’t worry if you don’t have everything figured out immediately.

The Process and What to Expect

Normally, CICA claims should be made within two years of reporting the abuse to the police. However, the CICA understands that survivors of domestic abuse may need more time, often because of fear, coercion, trauma, or ongoing control by the abuser. If you have delayed reporting or claiming, you may still be able to apply.

Once you have reported your abuse to the police, which needs to happen before you can make a claim, we can help gather any other relevant details. At this stage, we’ll talk you through the process and what you can expect.

Then, we’ll help you gather evidence – we’ll explain what you might need for your specific case, as we know all cases can differ. Building a strong case with evidence is key to securing the compensation you deserve.

After, we will submit the application on your behalf.  Our team can support you in explaining your circumstances to the CICA. It’s important to provide a clear and well-supported explanation for any delay, as this is often a crucial step where applications can struggle. Our specialists will work with you to ensure your reasons are presented effectively, giving your claim the best chance of success.

The CICA will review your application and any supporting evidence and may ask questions or require more evidence. This process can take a considerable amount of time and our Solicitors will keep you informed of any developments throughout.

Once the CICA make their decision, you’ll find out whether your claim was successful or not. If successful, you’ll receive a compensation offer. If rejected, we can consider your options to review the decision further.

CICA Domestic Abuse Claims – Frequently Asked Questions

Do I need a police conviction or a court case?

No. You only need to have reported the abuse to the police and provided enough information for the CICA to investigate. Many survivors worry that, because there was no prosecution or conviction, they cannot claim - this is not true. The CICA makes its own assessment.

How much could I receive?

Each claim is unique. The amount awarded depends on your injuries and circumstances, including loss of earnings or extra expenses if relevant. We can guide you through the process and help make the strongest possible case.

How long does the process take?

The process time can vary depending on your case, but usually, the CICA aim to make a decision on claims within 12 months. However, abuse claims can take longer and due to factors like CICA’s backlog of claims or evidence involved, it can take even longer. Your solicitor will be able to provide more accurate timelines for you and will always update you if there’s a change.

Will I need medical evidence in order to make a CICA claim?

Your solicitor will be able to advise on what evidence you may need, and you’ll always be able to ask questions if you’re unsure. Most often medical evidence is required and we can assist in obtaining this through our chosen panel of experts.

There’s a two-year deadline to make a claim, but I’ve missed it – can I still make a claim?

You may be able to make a claim even if you’ve missed the two-year deadline. Sometimes, the CICA look at factors that may have influenced your decision to not claim earlier. Our team will be able to advise you on making a claim, so don’t assume you won’t be able to straight away.

Do I need a solicitor to make a claim?

Although you can make a CICA claim without a solicitor, we strongly recommend seeking specialist legal representation. The claims process can be complex, and mistakes, missing evidence or unclear explanations may affect the outcome. An experienced solicitor can assess your eligibility, gather and present the right evidence, deal with the CICA on your behalf and advise you if a decision needs to be reviewed. At Farleys, we provide the legal expertise, practical assistance and sensitive support needed to take the pressure off you throughout your claim.

Do I have to pay to set up a CICA abuse claim?

We will act under a no win, no fee agreement which you can consider before starting the claim.
