Background
Mr C, a machine operative, sustained a serious injury while working on a bandsaw in the Burnley area. The machine lacked a safety guard and was unsuitable for the component he was tasked to cut. Compounding these risks, Mr C had not received adequate training or PPE for operating the machine.
While working on the bandsaw, the blade juddered unexpectedly, pulling Mr C’s glove toward the blade. His dominant right thumb came into contact with the blade, causing a severe and permanent injury. This incident not only impacted Mr C’s ability to work but also had long-term implications on his livelihood and quality of life.
How Farleys were able to help
Mr C instructed Paul Mulderrig of Farleys’ personal injury team to pursue a claim against his employer. Paul demonstrated that the employer had a duty of care toward Mr C and that they breached this duty by failing to supply suitable equipment and maintain safe working conditions. The insurers initially denied liability and made untruthful allegations regarding the accident circumstances, training provided, and safety measures in place.
This denial created significant challenges, so to establish the extent of Mr C’s injuries and their impact, Paul obtained expert evidence from an orthopaedic surgeon. The report confirmed the seriousness of Mr C’s injuries and the permanent consequences, enabling Paul to commence court proceedings.
As the matter approached trial, the third-party insurers changed their position and agreed to enter negotiations. During negotiations, Paul successfully secured a settlement of £42,500 in damages for Mr C.
