Mr A approached Farleys, after suffering a brutal and unprovoked assault during a night out. The attack left him with significant and lasting injuries, including moderate brain damage which affected his daily life, independence and long‑term prognosis.
How Farleys Were Able to Help
Jade Jump, Senior Associate and specialist in personal injury, took conduct of the case. She prepared and submitted the initial claim on Mr A’s behalf, ensuring all available evidence, including medical records, consultant letters and hospital documentation, was provided to the Criminal Injuries Compensation Authority (CICA). After some time, the CICA made an initial offer of £16,800.
However, Jade quickly identified that this award did not accurately reflect the extent or seriousness of Mr A’s injuries. The CICA had limited its assessment of Mr A’s brain injury to a two‑year period, yet almost two years had already passed and Mr A was not showing signs of significant improvement. Given the likely permanence of his condition, Jade advised Mr A that the offer was too low and recommended submitting an application for a formal review.
Acting on this advice, Jade undertook further detailed evidence gathering. She obtained updated records from Mr A’s GP, hospital team and specialist consultants to build a clearer and more compelling picture of his ongoing difficulties and long‑term prognosis. This was then presented to the CICA with a request to reconsider their decision.
The Outcome
Following the review, the CICA agreed with Jade’s submissions and increased Mr A’s award to £27,000, a significant uplift that better reflected the severity of his injuries and the lasting impact on his life.
Comment from Jade Jump, Senior Associate:
It’s important not to simply accept a CICA award at face value. Every award needs careful consideration to ensure it truly reflects the injuries suffered. We regularly see situations where a review is not only justified, but essential in ensuring clients receive the compensation they are entitled to.
I’m very pleased that we were able to secure this increased settlement for Mr A. By taking the time to properly evaluate the evidence and challenge the initial award, we successfully obtained an additional £10,000 for him. We are always happy to guide clients through this process and make sure their claims are presented as strongly as possible.
If you have been injured following a criminal act, you may be entitled to make a claim for compensation through the CICA. To discuss your circumstances, please contact our experienced personal injury specialists on 01254606008, contact us by email, or use the online chat below.
