Accidents / Assaults in Prison

Accidents / Assaults in Prison

At Farleys we understand that prisoners have rights like any other citizen and being in prison does not deny you access to compensation should you have suffered an injury that was not your fault.

The Prison Service has a legal duty to provide prisoners with a reasonable standard of living as well as safe working conditions. It also has a duty to protect vulnerable prisoners from assaults made by fellow inmates.

If you have suffered an injury as a result of the actions or negligence of the prison service, our specialist team of personal injury solicitors may be able to help you pursue a claim for compensation. You may be in prison at present, or you may recently have come out; either way, we will be able to advise you on making a compensation claim.

Accident in Prison Claims

If you have had an accident in prison which was due to the negligence of the prison authority, you may have a claim for compensation. You are fully entitled to make a personal injury claim and there has been a significant increase in the number of accident claims made by prisoners across the UK in recent years. Your claim may be in respect of a trip or fall, or as a result of an accident whilst working in prison.

Assault in Prison Claims

Your personal safety should be adequately protected by the prison authorities. Prisoners who have been convicted of certain crimes are at risk of being assaulted by other inmates. Such prisoners should be segregated or placed in a Vulnerable Person’s Unit (VPU) for their own protection. If the Prison Service has not adhered to this practice they may have failed in their duty to protect.

If you have suffered an injury as a result of an accident or assault which was the fault of the prison authority, you may have a claim for compensation. Even if you were partly to blame, there may be sufficient merit to pursue a claim.

Where possible, we handle compensation claims on a “no win no fee” basis, meaning there will be no cost to you throughout the course of the claim. To discuss the circumstances of your case and whether it may be possible to pursue a claim, contact one of our accident claim solicitors for a free initial discussion.
