Blackburn Road Traffic Accident – Ms P Awarded £90,000

Our client, Ms P*, contacted Farleys’ personal injury team after being involved in a road traffic accident that wasn’t her fault.

Ms P had been the driver of a vehicle travelling down a main road. Another vehicle exited a side road and collided with our client’s car on the passenger’s side. Ms P suffered immediate pain in the neck, back and right shoulder. The pain continued for some time so she sought medical care.

After several examinations by doctors, she was referred for acupuncture to assist with the pain. During her first acupuncture session two weeks later, Ms P experienced a seizure-like episode and so the acupuncture session was ended and she didn’t return for any further sessions. These seizures and spasms then continued causing Ms P extensive difficulties in everyday tasks.

She is now unable to drive due to the seizures and has had to surrender her license to the DVLA. Prior to the accident Ms P was a carer and part of her role was to transport patients in her car. As a result of the accident and subsequent injuries, Ms P was unable to do this and had to give up her role. She needs assistance with everyday tasks from her daughter and suffers poor mental health with anxiety and depression.

After instructing Farleys Solicitors to make a claim for compensation against the other driver’s insurers, our personal injury team reviewed extensive medical records and instructed experts to determine the physical and psychological injuries that were caused by the road traffic accident. This was a particularly challenging aspect of the case. We established her loss of earnings and the cost of any future care and rehabilitation and submitted the claim.

We negotiated with the defendant’s insurers and successfully claimed a final settlement of £90,000.
