What is the criteria for civil partnership dissolution

Criteria for Civil Partnership Dissolution

If there has been an irretrievable breakdown in the relationship between civil partners and the partnership has lasted for at least a year, a civil partnership can be dissolved on the basis of any of the following four conditions:

Unreasonable behaviour
Your partner leaving your home without your agreement more than two years ago
Separation for two years and agreement by both partners to dissolve
Separation for five years even if one partner does not agree to the dissolution

Financial settlement following civil partnership dissolution

The Court will not automatically consider issues surrounding maintenance, capital division or pensions, irrespective of whether these have been raised in the Dissolution Petition, as is normally the case.

If an agreement is reached in respect of financial matters, perhaps through mediation or other alternative dispute resolution, a binding agreement can be drafted, which will require approval from the Court. Our Solicitors have substantial experience in drafting such agreements and would be happy to also assist you in this.

If no agreement can be reached, financial Court proceedings can be commenced from the  day that your dissolution proceedings begin. Our solicitors can advise and assist you with this process and will always act in your best interests.
