This is one of the most common questions I am asked when a relationship breaks down. In most cases, it’s preferable to stay in the family home whilst resolving issues, particularly financial issues, following the breakdown of a relationship.

The key to ensuring early resolution is to try to give the solicitor you instruct as much information as possible. Do remember however, that this information has to be legitimately obtained. It’s not possible to rely on information that’s been illicitly acquired from your spouse’s confidential papers or emails. Even though it might not be possible to identify all of your spouses’ assets, a general picture allows us to provide you with realistic advice at the earliest possible stage so that you can positively move on to the next chapter in your life.
