Mr S approached Farleys’ personal injury team about the possibility of bringing a claim against his employer after an accident at work left him with serious injuries.

Background

Mr S was an apprentice joiner approaching the end of his apprenticeship. At the time of the incident, he was working outside under the instruction of his employer. He had not been instructed to wear goggles or glasses to complete the work. While using a tool to dislodge wood, Mr S sustained an eye injury from a piece of metal.

After the incident, Mr S washed his eye and took some painkillers. He was then expected to continue working by his employer. Mr S was still experiencing pain and discomfort by the evening so attended hospital to have it examined.

At the hospital, it was found that Mr S had suffered a serious eye injury and still had a piece of metal in his eye. He suffered a laceration through the cornea scleral junction impacted on the retina just superior to the optic nerve.

Mr S underwent three surgeries but unfortunately, lost most of the sight in his eye. The vision he has left in his eye now is of very little daily use. There were no further options for surgery and he will not recover the sight he has lost.

How Farleys were able to help

Mr S instructed Holly Barnes to act on his behalf in a claim against his employers. Holly and her team worked hard to build a case which highlighted the losses suffered by Mr S as a result of the accident which included his loss of earnings, the help he required at home, his disadvantage on the open labour market, and the cost of future treatment.

Our team arranged conferences with counsel and medical experts to support Mr S’ claim.

We successfully secured a settlement of £155,000 which covered the physical and psychological injuries suffered by Mr S as a result of his injury.

Holly Barnes commented,

Mr S’ life has been hugely impacted by the injury he suffered as a result of the negligence of his employer. Had the proper health and safety systems been in place for Mr S, the accident would not have occurred. My client has suffered a life-changing injury and continues to do remarkably well in his recovery.

“We were pleased to have successfully recovered these damages for Mr S to assist in his recovery and to ensure he has the funds in place to compensate him for both past and future losses. We wish him all the best”
