Mr K approached Farleys’ personal injury team about the possibility of pursuing a claim for compensation after he suffered injuries in an accident when his bike malfunctioned.
Background
Two weeks before the accident in question, Mr K had purchased a specialised bike from a shop in Manchester. On the day of the incident, Mr K was cycling along a busy road in the city when the crank shaft of his bike fell off along with the pedal causing him to fall off his bike and into the road.
Luckily Mr K managed to avoid being hit by any vehicles in the road but he did suffer injuries from the fall, namely to his neck and back.
How Farleys were able to help
Mr K instructed Jade Jump of Farleys’ personal injury team to pursue a claim for compensation from the shop which had sold him the defective product.
While the claim was progressing, Jade secured an initial interim payment of £1,000 for 12 sessions of physiotherapy for Mr K’s neck and back. Jade also instructed a medical expert to produce a report on the extent of Mr K’s injuries and the timeframe for his recovery was set at nine months.
An initial settlement offer was made but through negotiations and a threat of court proceedings, the final accepted settlement was made at £4,374. The settlement covered the injury, required physio, travel expenses and the cost of Mr K’s designer clothing which was damaged in the accident.
Jade Jump commented,
As a result of this defective product, Mr K has suffered injuries which could easily have been much worse. It is hoped that through making this claim, more care will be given to the safety of products before they are sold.
