Farleys’ personal injury team was approached by Mr D about the possibility of making a claim for compensation after he suffered life changing injuries in an accident at work.

Background

Mr D was working as an apprentice at the time of the accident. He was asked by his supervisor to go up a ladder onto the roof of a house. While getting from the ladder onto the roof, Mr D fell backwards off the roof.

Mr D suffered devastating and life changing injuries in the form of serious fractures to both of his heels. He required multiple operations including surgery to fuse his bones back together. He is now unable to work a manual job and is classed as disabled as a result of his injuries. He requires assistance and adaptations at home including help with stairs and specialist shoes.

How Farleys Were Able to Help

Mr D instructed Nick Molyneux of Farleys Solicitors to act on his behalf in a claim against his employer for the negligence which caused Mr D’s accident. Nick instructed medical experts to assess Mr D’s injuries and give their expert opinion on his future treatment and prospects on the job market. He received reports from experts in orthopaedics, psychiatry, care, an orthotist, and an engineer regarding working at height.

Once we had filed a claim against Mr D’s employer, liability for the accident was disputed with Mr D’s employer claiming the accident was Mr D’s fault. Nick maintained that the accident would not have happened had Mr D been supplied with a roof ladder. There was still no admission of liability.

Despite liability being strongly denied by the employer, Nick fought Mr D’s case and with the help of the expert reports to put a strong case to Mr D’s employers and negotiated a settlement which took into consideration the extreme pain and suffering Mr D had experienced, his inability to work during his recovery, and his future disadvantages on the job market. They reached a successful settlement of almost a quarter of a million pounds.
