Judgment has recently been handed down by Mr Justice Peter Jackson in relation to two brothers let down repeatedly by Lancashire County Council Social Services Department.

The boys were allowed to drift from one placement to another.  One was moved between 96 foster parents and both suffered abuse.

The Judgment highlights the repeated failings of Social Services and Farleys are now instructed to pursue a civil claim for damages.

We have significant expertise in such claims which will often include various heads of damage.  Without commenting specifically on this case claims of this nature will often result in a damages claim under the 1998 Human Rights Act, particularly Article 8, which guarantees everyone the right to respect for his private and family life.  A damages claim will also include an award for pain and suffering and in particular psychological injury.  In this type of claim there may also be a claim for future loss of earnings and in the more extreme cases for future care where the negligent actions of the Social Services Department have left a child with far less chances in the future than may otherwise have been the case.
