Please find below descriptions of recently concluded commercial litigation cases our team has been instructed in.

• Acted for the claimant company in an action for damages against a former director for losses sustained as a result of breaches of fiduciary duties. The claim was settled for a substantial sum including costs at formal mediation.
  
• Farleys acted for the Defendant in successfully striking out a claim brought in the High Court of Justice. The claim was for damages of £200,000 for an alleged conversion of company shares. The case was struck out with the Claimant being ordered to pay the Defendant's costs

• Farleys successfully acted for the Claimant in a multi-track claim heard at Worcester County Court. The Claimant was further successful in having the counterclaim dismissed and being awarded a costs order against a non-party to proceedings.

• Represented Respondent to an application for adverse possession before the Lands Tribunal. The application was heard at a 5 day hearing
  
  
• High Court application at Manchester Civil Justice Centre for the restoration of a company to the Register under the Companies Act.
  
  
• Represented the Claimant in an action for commercial fraud for losses sustained as a result of false accounting.
  
  
• Acted for the Claimant in an action brought in conversion. The Claimant was eventually successful at a trial at Preston County Court.
  
  
Represented the Defendant in a claim brought under the Consumer Credit Act for a sum exceeding £675,000.


Represented the Respondent to an application for a freezing injunction by a large international vehicle manufacturer in proceedings in the Royal Courts of Justice, based upon allegations of fraud.


Represented the applicant, an association in the entertainment industry, for Judicial Review, in the Royal Courts of Justice, London.


Successfully pursued a claim for breach of contract on behalf of the Claimant in the Mercantile Court pleaded in excess of £130,000 while defending a counterclaim in excess of £200,000.


Represented the Applicant to an application to vary a Restraint Order over assets of a third party. The assets had been restrained pursuant to the Proceeds of Crime Act due to allegations of serious fraud.


Represented the Claimant in an action for injunctive relief in the Manchester High Court. The Claimant successfully restrained a competitor from distributing a publication which was in breach of the tort of 'passing off'.
